Un concept est avant tout une id\u00e9e. Une id\u00e9e qui sera la base d\u2019un produit, d\u2019une communication, ou de tout un univers commercial qui, si elle est novatrice et bien vendue, peut devenir un succ\u00e8s commercial. Or, les id\u00e9es ne sont pas prot\u00e9geables juridiquement.<\/span><\/span><\/p>\n

Pourtant, certains concepts ont potentiellement une grande valeur, en plus d\u2019avoir n\u00e9cessit\u00e9 des investissements importants. Le risque est qu\u2019un concurrent reprenne ce concept. Alors, comment s\u00e9curiser un concept\u00a0? M\u00eame si une id\u00e9e n\u2019est pas prot\u00e9geable, des moyens existent.<\/p>\n

Qu\u2019est-ce qu\u2019un concept ? <\/u><\/b><\/div>\n

Un concept est un ensemble d\u2019id\u00e9es novatrices<\/b> sur un objet concret ou abstrait ou sur l\u2019ensemble des caract\u00e9ristiques d\u2019un nouveau projet concret ou abstrait. On parlera seulement ici de concept \u00e9conomique (commercial ou d\u2019entreprise). <\/span><\/span><\/div>\n

Un concept peut \u00eatre par exemple\u00a0:<\/span><\/span><\/div>\n

  • Un ensemble de signes qui rendent l\u2019entreprise unique, avec un savoir-faire (connaissances, m\u00e9thodes, outils) particulier, qui finalement forge une identit\u00e9 unique \u00e0 l\u2019entreprise\u00a0;<\/li>\n
  • Un projet d\u2019entreprise particulier\u00a0;<\/li>\n
  • Une association originale de domaines diff\u00e9rents\u00a0;<\/li>\n
  • Une fa\u00e7on originale de pr\u00e9senter un magasin, de vendre ou de relier diff\u00e9rents services ensemble\u00a0;<\/li>\n
  • Un produit ou service novateur ou dont la logique est originale\u00a0;<\/li>\n
  • Un concept de formation\u2026<\/li>\n<\/ul>\n

    Cependant, selon le fameux adage juridique attribu\u00e9 \u00e0 Henri Desbois\u00a0: les id\u00e9es sont \u00ab\u00a0par essence et par destination de libre parcours\u00a0\u00bb.<\/b> Elles ne sont pas prot\u00e9geables. Seule la mat\u00e9rialisation de cette id\u00e9e peut l\u2019\u00eatre. Cela peut sembler brutal pour certains entrepreneurs ayant mont\u00e9 un concept \u00e0 succ\u00e8s ou pour les jeunes entrepreneurs pensant avoir trouv\u00e9 le concept qui permettra de lancer leur entreprise, mais c\u2019est la r\u00e9alit\u00e9 juridique dans l\u2019immense majorit\u00e9 des pays, dont la France. <\/span>
