{"id":6639,"date":"2022-08-12T12:07:20","date_gmt":"2022-08-12T10:07:20","guid":{"rendered":"https:\/\/www.copyright.eu\/docs\/legal-force-of-qualified-electronic-timestamping-compared-to-others\/"},"modified":"2022-08-12T12:07:20","modified_gmt":"2022-08-12T10:07:20","password":"","slug":"legal-force-of-qualified-electronic-timestamping-compared-to-others","status":"publish","type":"docs","link":"https:\/\/www.copyright.eu\/en\/docs\/legal-force-of-qualified-electronic-timestamping-compared-to-others\/","title":{"rendered":"Legal force of qualified electronic timestamping compared to others"},"content":{"rendered":"<div class=\"slds-rich-text-editor__output uiOutputRichText forceOutputRichText\" dir=\"ltr\" data-aura-rendered-by=\"11:172;a\" data-aura-class=\"uiOutputRichText forceOutputRichText\">\n<p class=\"intercom-align-left\" data-aura-rendered-by=\"12:172;a\"><strong>Only <u>qualified<\/u> electronic timestamping can be used to prove the anteriority of a file, as it benefits from a presumption of reliability as provided by law: <\/strong>\n<\/p>\n<p class=\"intercom-align-left\" data-aura-rendered-by=\"12:172;a\"><em>\u00ab\u00a0A qualified electronic timestamp benefits from a presumption of accuracy for the date and time it indicates and of integrity for the data to which that date and time relate.\u00a0\u00bb<\/em> Article 41 of the eIDAS Regulation.\n<\/p>\n<p class=\"intercom-align-left\" data-aura-rendered-by=\"12:172;a\">Thus, contrary to popular belief, other types of electronic timestamps (or electronic signatures of any kind) are not sufficient on their own to prove the anteriority of a certificate <b>with a presumption of legal reliability.<\/b><\/p>\n<p class=\"intercom-align-left\" data-aura-rendered-by=\"12:172;a\">Indeed, the vast majority of timestamps or electronic signatures are based on the time and date that are attached to the computer (the \u00ab\u00a0atomic\u00a0\u00bb time): in other words, they are easily falsifiable!<\/p>\n<p class=\"intercom-align-left\" data-aura-rendered-by=\"12:172;a\">In contrast, with qualified electronic timestamping, this technical operation must be carried out by a specific and external timestamping authority, a qualified trust service provider registered on the European Union list. There are only a limited number of such providers and Copyright.eu uses one of them.<\/p>\n<p class=\"intercom-align-left\" data-aura-rendered-by=\"12:172;a\">That is the reason why Copyright.eu always combines the electronic sealing of its certificates of anteriority or contracts exclusively with a qualified timestamp.<\/p>\n<p>Other types of timestamps could easily be challenged in court. For this reason, it is necessary to entrust the proof of anteriority of your creations and documents to a professional specialising in intellectual property, such as Copyright.eu.<\/p>\n<p><img
